Massachusetts Nuptial Agreement Attorney — Nuptial Agreements in MA

There are two kinds of Nuptial Agreements in Massachusetts

Key Point

A post nup is signed by people who are already legally married. A prenup is signed by people who are still engaged. That single timing difference changes how much protection each document gets in court.

How a Post Nup Differs From a Prenup

The core difference is leverage, and Massachusetts courts take that seriously. If signed well before a wedding, a person can generally choose to walk away and stay single if they don’t like the terms of a prenuptial agreement. Once a couple is married, that option is gone — refusing to sign a postnuptial agreement doesn’t undo the marriage. Because a spouse who is asked to sign a post nup may feel pressure to agree just to keep the marriage intact, Massachusetts courts scrutinize post nups more closely than prenups for signs of coercion or unfairness.

Leverage concern

Lower — parties can call off the wedding

High level of scrutiny. Married partners can place partners under duress very easily.

Court review standard

“Fair and reasonable” review both at signing and at time of divorce.

Same standard, applied more strictly at signing and at time of divorce.

Common triggers

Upcoming marriage, existing wealth, family interests, prior children.

New business, inheritance, reconciliation, infidelity, children outside the marriage.

Why Hiring a Massachusetts Nuptial Agreement Lawyer Is Essential

Perhaps the single most critical step in creating a valid nuptial agreement is ensuring that both parties are represented by their own independent Massachusetts nuptial lawyer. Having separate legal counsel protects each person’s individual interests and significantly strengthens the enforceability of the agreement.

An experienced Massachusetts Nuptial Agreement Attorney will:

  • Educate the client on full requirements and duties under Massachusetts General Laws.
  • Ensure all legal requirements under Massachusetts law are met
  • Guide you through proper full financial disclosure
  • Negotiate terms that are fair and reasonable for both parties
  • Draft an agreement built to withstand court scrutiny under the heightened fairness standard applied to nuptial agreements
  • Protect your rights and financial interests both now and in the future
  • Educate the client of all of their rights under the law.

The process for getting a nuptial agreement is very simple. Just call our office or fill out the form below, and we can start the process and provide instructions on the information we need. Melcher Law PC does both sides of this kind of matter. We create nuptial agreements and review nuptial agreements prepared by other attorneys.
